| Criminals aged 75 and older will not be subjected to capital punishment unless they are guilty of the "extreme brutality" of murder, according to the latest draft amendment to the China's criminal law, Xinhua reports. The stipulation, included in the second draft of the eighth amendment to the law, was submitted on Monday to the National People's Congress (NPC) Standing Committee, the country's top legislature. The first draft released in August proposed to spare those over 75 from the death penalty and has since been revised after concern over the possibility of gangs employing the elderly to commit serious crimes, or the elderly simply committing murder from their own motivations. |
新華社消息，最新的刑法修正案草案規定，已滿75周歲的老人犯罪不適用死刑，但以特別殘忍手段致人死亡的除外。本周一，刑法修正案（八）草案二審稿提交全國人大常委會審議。今年八月公布的草案初審稿曾規定，已滿75周歲的老人若犯罪可免予死刑。但后來考慮到可能會有犯罪集團雇用老人實施特別嚴重的犯罪，且可能會有部分老人故意實施犯罪，遂對該規定作出修改。 |

此次審議的草案還規定，黑社會頭目及組織者將被處七年以上﹑15年以下有期徒刑，并對減輕刑罰事宜作了具體要求，明確表示對如實供述自己罪行﹑最大限度減少損失的犯罪嫌疑人可寬大處理。
