??????? 刑事拘留（criminal detention）后撤銷案件放人的情況，到底是否應給予國家賠償（state compensation），成為國家賠償法修改中一個難題。
???????4月26日下午，十一屆全國人大常委會第十四次會議在人民大會堂舉行第一次全體會議。提請第四次審議的國家賠償法修改草案（the draft amendments to the State Compensation Law），針對上述難題給出解決方案。
???????法律委員會認為，對于違反刑事訴訟法（Criminal Procedure Law）的規定采取刑事拘留措施的，應當明確規定受害人有取得國家賠償的權利（be entitled to...）。采取拘留措施的時間超過規定時限（beyond the legally permitted period），其后決定撤銷案件的，應當規定受害人有取得賠償的權利。請看新華網的報道：

???????國家賠償（state compensation），又稱國家侵權損害賠償，是由國家對于行使公權利的侵權行為造成的損害后果承擔賠償責任的活動。
???????現行的《中華人民共和國國家賠償法》于1995年生效。該法第2條規定：
???????國家機關和國家機關工作人員違法行使職權侵犯公民，法人和其他組織的合法權益造成損害的，受害人有依照本法取得國家賠償的權利。
???????Citizens, legal persons or other organizations have the right to seek compensation from the state if state organs and office holders abuse their power and infringe upon their lawful rights and interests and have caused damages thereof.
